Can I do short-term rentals in Tampa?
Short Answer
It depends on the zoning. In a 2022 case, a court upheld a code violation against a two-night rental of a South Tampa home zoned RS-60, reading the code to allow only weekly or longer rentals there. Other zones may differ. Check the parcel's zoning with Tampa Planning and Zoning, plus any HOA or condo rules, before you buy.
Can I do short-term rentals in Tampa?
Maybe. It turns on the zoning of the exact parcel, then on any HOA or condo rules.
In a 2022 decision, Super Host, LLC v. City of Tampa, the circuit court's appellate division upheld a code violation for a two-night rental of a South Tampa home zoned RS-60. The court read Tampa's code to allow rentals in that zone only on a weekly or longer basis. That ruling covered one property and one zone. Other zones may differ, and the code may have changed.
As of November 3, 2026, I didn't find a city short-term rental registration program in Tampa.
What this looks like in Tampa Bay
Each city and county sets its own rules within state law. Florida law says new local rules can't ban vacation rentals or limit how long or how often they're rented. But local rules adopted on or before June 1, 2011 still stand. That's why rules vary so much from one town to the next.
Step by step before you buy
- Look up the parcel's zoning and ask Tampa Planning and Zoning whether short stays are allowed.
- Read the HOA or condo documents for rental limits.
- Plan for a state vacation rental license from DBPR.
- Register for state sales tax and county tourist development tax.
- Build the zoning check into your inspection period.
Short-term vs longer rentals in Tampa
| Under 30 days | Monthly or longer | |
|---|---|---|
| Zoning risk | Depends on the zone | Lower |
| State license | Needed if rented more than three times a year | Not as a vacation rental |
| Tourist tax | Yes | Rentals over six months aren't taxed |
| HOA limits | Common | Less common |
What you control and what you don't
You control which parcel you buy and how much you check first. You don't control the zoning code or the association's rules.
Common mistakes
- Trusting a listing that says "Airbnb friendly."
- Buying first and checking zoning later.
- Forgetting the association can be stricter than the city.
Can I rent out my property short-term anywhere in Tampa Bay?
Rules change by city, county, and beach town. Some beach towns have minimum stays. Read the city sections in the Tampa Bay short-term rental rules guide.
Reading Tampa's code for one parcel
Start with the City of Tampa zoning map and write down the district for the exact parcel. Then read the use rules for that district in the city code. Look at how the code defines a dwelling, a rental, and any minimum stay. If the wording leaves room for doubt, ask the city's zoning office in writing. A written zoning verification letter costs a little time and can save a deal.
What the Super Host case means for buyers
The 2022 ruling dealt with one South Tampa home and one zone. It doesn't settle every Tampa address. What it does show is that a city can enforce its existing code against a short stay, and that a court may read that code strictly. If a listing says "Airbnb friendly," treat that as marketing until the zoning answer comes back.
Inside and outside city limits
City rules stop at the city line. Brandon, Riverview, Apollo Beach, and Town 'n' Country are unincorporated Hillsborough, which has its own registration ordinance starting January 1, 2027. Temple Terrace and Plant City are separate cities with their own codes. A Tampa mailing address doesn't always mean the City of Tampa, so check the parcel on the Hillsborough County Property Appraiser site.
Condo towers downtown and on the water
Many downtown, Channelside, and Harbour Island buyers look at condos. In a tower, the association documents usually matter more than zoning. Many buildings set minimum lease terms or cap how often you can lease. Ask for the declaration, rules, and any recent amendments before you write.
Plan B: monthly and seasonal stays
If short stays aren't allowed, a rental may still work for stays of a month or longer. Tampa draws traveling medical staff, seasonal residents, and people between homes. Those stays can fall outside the short-stay rules, but they bring their own lease, tax, and association questions. Run the numbers both ways before you buy.
Writing the offer
Florida's standard contract gives you an inspection period. Use it for the zoning check too. I build the zoning letter, association documents, and insurance quotes into that window. If the answers don't support your plan, you can decide before the deadline.
Questions to ask
- What zoning district is the parcel in?
- Does the code set a minimum stay for that district?
- Has the city issued violations at this address?
- Do association rules allow short stays?
- Can the property still work as a monthly rental?
Neighborhood fit
Some Tampa streets see a lot of rentals and some see very few. Code complaints usually start with neighbors. Before you buy, drive the street at night and on a weekend and think about parking and noise.
What to do next
Read the Tampa Bay short-term rental rules guide. If a property must work as a rental, book a consult and I'll build the zoning check into the offer timeline.
This is general information, not legal advice. Rules depend on the parcel and can change, so confirm with the city or county and a Florida attorney before you buy.
